1 — Scope of Application; Contract Language

(1) These General Terms and Conditions of Sale (GTC) apply to all contracts concluded between you and:

These GTC govern the use of our online store as well as the sale of our products.

2 — Applicable Law; Protection of European Consumers

(1) For customers residing outside the European Union, these GTC are governed by the laws of the State of New Mexico (USA), excluding its conflict of laws rules.

(2) For customers residing within the European Union, the contract is also governed by the laws of New Mexico.

However, this choice of law may not deprive European consumers of the protection guaranteed by the mandatory legal provisions of their country of residence.

This includes, in particular:

• the right of withdrawal under Directive 2011/83/EU,
• the legal guarantee of conformity (Directive 1999/44/EC or EU Regulation 2019/771),
• all mandatory national consumer protection laws.

3 — Formation of the Contract

(1) The presentation of products on our website constitutes an invitation to place an order and not a binding offer.

(2) By clicking the “Buy” / “Order” button, you submit a binding purchase offer.

You will receive an acknowledgment of receipt, but this does not constitute acceptance.

The contract is concluded when:

• ACCARS-AUTO sends you a confirmation email, or
• ships your order.

Please check your spam folder regularly.

4 — Technical Ordering Process and Correction of Errors

During the ordering process, you may:

• add or remove items from the cart,
• modify quantities,
• update your personal information,
• change the delivery or payment method.

A summary page allows you to review your order before validation.

To interrupt the ordering process, simply close the browser window.

Once the “Buy” button has been validated, the order becomes binding in accordance with Section 3.

5 — Contract Storage

The contractual information, including these GTC and the details of your order, will be sent to you by email upon acceptance of your order.

ACCARS-AUTO does not store the contract text in a manner accessible to the customer.

7 — Payment

(1) The total amount is due immediately at the time of ordering.

(2) The available payment methods (credit card, PayPal, Klarna, Stripe, etc.) are displayed during checkout.

8 — Retention of Title

The products remain the property of ACCARS-AUTO until full payment of the purchase price has been received.

9 — Right of Withdrawal & Returns Policy (European Customers)

9.1 — Statutory Right of Withdrawal (EU)

Customers residing in the European Union benefit from a statutory 14-day right of withdrawal in accordance with Directive 2011/83/EU.

The withdrawal period begins on the day you receive the goods.

9.2 — Exercising the Right of Withdrawal

Please include your order number and the items concerned.

9.3 — Returns

Items must be returned within 14 days following notification of your withdrawal.

A link to initiate your return will be available soon.

Return shipping costs are borne by the customer unless the item is defective or ACCARS-AUTO has made an error.

General return conditions:

• return the item in its original packaging,
• submit your request within 30 days of receipt,
• return the item only if customer service requests it (in the event of a product error),
• do not remove labels or tags,
• return items in their original condition.

Damaged items will not be refunded.

9.4 — Refunds

We refund:

• the amount paid,
• the original standard delivery costs,

within a maximum period of 25 days after receipt of the returned item.

9.5 — Depreciation of Goods

Any loss in value resulting from excessive handling (beyond what is necessary to establish the nature, characteristics, and functioning of the product) may be charged.

10 — Statutory Warranties (EU Customers)

In accordance with European legislation:

• you benefit from a 2-year legal guarantee of conformity,
• as well as the legal warranty against hidden defects.

Any defect appearing within 12 months following delivery is presumed to have existed at the time of receipt, unless proven otherwise.

11 — Liability

ACCARS-AUTO shall be liable:

• in cases of gross negligence or intentional misconduct,
• in cases involving injury to life, health, or physical integrity,
• in accordance with applicable product liability laws.

For ordinary negligence, liability is limited to foreseeable damages typical of the contract.

12 — Dispute Resolution

You may refer disputes to:

• the courts of your country of residence, or
• the European Online Dispute Resolution platform:

13 — Severability Clause

If any provision of these GTC is held to be invalid, the remaining provisions shall remain fully applicable.
